Trailblazer Terms and Conditions

1. Introduction

The Owner and Manager reserve the right to terminate permission to occupy and to evict from the Vacation Rental any Guests or Visitors who refuse to follow these Terms and Conditions or who cause a nuisance to neighbors or other residents of the community. Compliance with these Terms and Conditions at the Vacation Rental Property is a requirement of the vacation rental agreement. Failure to adhere may result in penalties such as deductions from the security deposit, additional charges, or immediate eviction without refund.

By completing your booking, you acknowledge and agree to abide by these Terms and Conditions.

2. Property Details

3. Rates & Payments

3.1. A 50% deposit is required upon booking; the remaining balance is charged 60 days prior to arrival.

3.2. If booking occurs within 60 days of arrival, the total amount is due at booking.

3.3. All payments must be made by credit card. No checks, wire transfers, or cash payments are accepted.

3.4. Failure to make timely payments or sign the rental contract within 96 hours may result in cancellation and a retained booking fee.

3.5. Promotional offers are subject to blackout dates, are not retroactive, and are limited to one per reservation.

3.6. We reserve the right to correct any misprinted or incorrectly quoted rates.

3.7. Adjustments to tax rates made after booking will be charged to the credit card on file.

3.8. Deposited funds may be held in interest-bearing accounts for the benefit of management.

4. Refunds & Cancellation Policy

4.1. All pre-payments are non-refundable except as outlined herein.

4.2. Cancellations within 48 hours of booking (if arrival is more than 14 days away) are eligible for a full refund.

4.3. Cancellations made 60 or more days before arrival are refunded 50% of pre-payments.

4.4. Cancellations within 59 days of arrival are fully non-refundable.

4.5. No refunds will be issued for changes to decor, amenities, acts of nature, or mandatory evacuation orders.

4.6. Travel insurance is strongly recommended.

4.7. If the reserved home becomes unavailable due to sale or other reasons, a comparable home or full refund will be offered.

5. House Rules & Terms of Occupancy

General Conduct:

• Guests must follow all posted rules and instructions from the Property Manager.

• Immediate notification is required for disputes or neighbor complaints.

Noise & Neighborhood:

• Quiet hours are strictly 10:00 PM – 7:00 AM.

• Excessive noise may result in eviction.

Visitors & Functions:

• Maximum of 2 visitors at a time unless pre-approved.

• No parties, events, bachelor/bachelorette parties, or large gatherings allowed without written approval.

Parking:

• 1 vehicle allowed in the garage, 1 in the driveway.

• Overflow parking is not guaranteed and must follow HOA guidelines.

Garbage:

• Place trash securely in bins inside the garage.

Security:

• Lock all doors and windows when leaving the Property.

• Turn off unnecessary lights and electronics when not in use.

Hot Tub Use:

• Permitted between 7 AM and 10 PM.

• No glass in or near the hot tub; always replace the cover after use.

Balcony Use:

• Children must be supervised at all times on balconies or decks.

Smoking/Vaping:

• Prohibited indoors.

• Outdoor smoking must occur 30+ feet away from the Property; proper disposal required. Violations incur a minimum $500 fee.

Pets:

• Pets are not allowed unless approved in writing. Unauthorized pets will result in fees and/or eviction.

Grill Use:

• Grills are to be used only by responsible adults (18+).

Damages:

• Guests are responsible for damages beyond normal wear and tear.

• Do not move furniture without prior approval.

• No Property towels are to be used outside.

Check-Out Requirements:

• All trash disposed of properly.

• All dishes cleaned and put away.

• Electronics and lights turned off.

• All doors locked securely.

• Garage door opener returned to designated location.

6. Care & Condition of the Home

6.1. Guests must maintain the Property in clean, undamaged condition.

6.2. Report any damages immediately.

6.3. Any excessive utility usage (exceeding normal levels by 20%) may be billed separately.

7. Security Deposits & Preauthorization Charges

7.1. A refundable security deposit of $1,500 (or pre-authorization hold) is required.

7.2. Deposits are refunded within 7 days post-departure, subject to satisfactory inspection.

7.3. Damages exceeding the deposit will be charged to the credit card on file at 18% annual interest if unpaid.

8. Guest Responsibilities

8.1. Homes are for private vacation use only; commercial use requires prior approval.

8.2. The Lead Guest must be at least 21 years old and present for the duration of the stay.

8.3. Compliance with occupancy and noise ordinances is required.

8.4. Noise monitoring devices may be used; violations may incur a $500 charge and/or eviction.

8.5. Unauthorized subleasing, resale of reservations, or overcrowding may result in immediate eviction.

9. Swimming & Amenities Use

9.1. Pools, hot tubs, and water bodies are used at Guest’s own risk; no lifeguards are present.

9.2. Guests must supply their own beach and pool towels.

9.3. Damage to amenities or excessive cleaning needs may result in additional charges.

10. Service Animals

10.1. Service animals trained to assist individuals with disabilities are allowed without pet fees.

10.2. Guests are responsible for damages caused by service animals.

11. Liability & Indemnification

11.1. Guests assume all risks associated with occupancy, including injuries, illnesses, theft, or loss.

11.2. Trailblazer, MONTANA CALLING, LLC, and the Property Owner are not liable unless gross negligence is proven.

11.3. Guests agree to indemnify and hold harmless management and ownership from claims arising from rental use.

12. Check-In & Check-Out

12.1. Guests must follow the confirmed check-in and check-out times.

12.2. Early arrivals or late departures may incur additional fees.

12.3. Failure to vacate the Property on time may require rebooking alternate lodging for incoming guests at the guest's expense.

13. Termination

Violation of these Terms and Conditions may result in immediate eviction without refund and additional charges.

14. Governing Law & Disputes

14.1. This Agreement shall be governed by the laws of the State of Montana.

14.2. Legal disputes must be filed in the state or federal courts of Kalispell, Montana.

14.3. Both parties waive the right to a jury trial and consent to electronic signatures and communication.

Acceptance

By booking the Property, you acknowledge that you have read, understand, and agree to comply with these Terms and Conditions.
